1. General Provisions
1.1. These Terms and Conditions govern the use of our webshop, accessible at www.mightylu.com (hereinafter “Webshop”), operated by MightyLu j.d.o.o., with registered office at Dobrinjska ulica 17, 10000 Zagreb, Croatia, registered with the Commercial Court in Zagreb under registration number (MBS) 081480323, company ID (MB) 05695031, OIB 26937773008.
1.2. By using our Webshop and placing orders, you agree to these Terms and Conditions. If you do not agree, please do not use our Webshop.
1.3. We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our Webshop and will apply from the date of publication. Orders are governed by the version in force at the time the order was placed.
1.4. The customer is any natural or legal person who places an order in the Webshop for delivery to one of the countries listed in section 4.1. In accordance with the Consumer Protection Act, a contract on behalf of and for the account of a minor or a person deprived of legal capacity may be concluded only by their legal representatives. These Terms and Conditions are drawn up in accordance with the Croatian Consumer Protection Act (Official Gazette 19/22, 59/23, 59/26), including its provisions on distance contracts, and constitute the information provided to the consumer before the contract is concluded. By ordering products, the customer confirms acceptance of these Terms and Conditions.
2. Ordering
2.1. To place an order, you must be at least 18 years old and legally capable of entering into binding contracts.
2.2. All orders are subject to acceptance and availability. We reserve the right to refuse an order.
2.3. After placing an order, you will receive an email acknowledging receipt of your order. This email does not confirm acceptance of your order. The contract between us will be formed when we send you a confirmation email that the products have been dispatched.
3. Pricing and Payment
3.1. Prices are listed in euro (EUR) and include VAT.
3.2. We reserve the right to change prices at any time. However, the price you pay will be the price displayed at the time you placed your order.
3.3. Prices do not include shipping costs. Shipping costs will be calculated and displayed during the checkout process, before you place your order.
3.4. We accept the following payment methods: credit and debit cards and Google Pay (processed securely by WooPayments; we do not see or store your full card details), direct bank transfer, and cash on delivery (an additional fee may apply and is shown at checkout before payment).
4. Delivery
4.1. We deliver to the following countries: Croatia, Slovenia, Austria, Germany, Italy, France, Czech Republic, Hungary, Slovakia, Belgium, Denmark, Luxembourg, Netherlands, Poland, Portugal, Spain, Sweden, Switzerland and Norway. Delivery costs and timescales will be specified during the checkout process.
4.2. Delivery times are estimates and we are not liable for any delays caused by customs or other factors beyond our control. For deliveries to Switzerland and Norway, import duties and taxes may be charged by the local authorities and are borne by the customer.
4.3. Risk of loss and title for products pass to you upon delivery.
5. Right of Withdrawal, Returns and Refunds
5.1. You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, take physical possession of the products.
5.2. To exercise the right of withdrawal, you must inform us of your decision by a clear statement sent by email to info@mightylu.com or by post to MightyLu j.d.o.o., Dobrinjska ulica 17, 10000 Zagreb, Croatia. You may use our model withdrawal form (PDF), but it is not obligatory.
5.3. You must send back the products without undue delay and in any event not later than 14 days from the day on which you communicated your withdrawal to us. You bear the direct cost of returning the products. You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
5.4. We will refund all payments received from you, including the costs of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold the refund until we have received the products back or you have supplied evidence of having sent them back, whichever is earlier. We will carry out the refund using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; for cash on delivery orders we will refund to the bank account you provide.

6. Liability
6.1. To the extent permitted by law, we are not liable for any indirect, special, incidental, or consequential damages arising out of or in connection with your use of our Webshop or purchase of products.
6.2. To the extent permitted by law, our liability for any claim relating to the products will be limited to the amount you paid for the products.
6.3. Nothing in these Terms and Conditions excludes or limits your statutory rights as a consumer, including the legal guarantee for material defects, or our liability for damage caused intentionally or through gross negligence.
7. Privacy and Data Protection
7.1. We are committed to protecting your privacy and personal data. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.
7.2. We process the personal data needed to fulfil your order on the basis of our contract with you; other processing is described in the Privacy Policy.
8. Governing Law and Dispute Resolution
8.1. These Terms and Conditions are governed by the laws of Croatia. If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence.
8.2. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved by the competent court in Zagreb, Croatia. If you are a consumer, you may also bring proceedings before the courts of your country of residence.
8.3. We will always try to resolve any complaint directly with you first. The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Information on consumer rights and on out-of-court dispute resolution bodies in the EU is available on the European Commission’s Consumer Redress in the EU portal.
