Terms and Conditions

  1. General Provisions

1.1. These Terms and Conditions govern the use of our webshop, accessible at [www.mightylu.com] (hereinafter “Webshop”), operated by [MightyLu J.D.O.O.], with registered office at [Dobrinjska ulica 17, 10000 Zagreb], Croatia, registered in the Commercial Court  in Zagreb under [MB: 05695031 ].

1.2. By using our Webshop and placing orders, you agree to these Terms and Conditions. If you do not agree, please do not use our Webshop.

1.3. We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our Webshop and will apply from the date of publication.

1.4. The customer is any legal or natural person whose registered office/residence is located in the territory of the Republic of Croatia and who places an order and makes a payment in the mightylu.hr online store. In accordance with Article 43 of the Consumer Protection Act, a contract on behalf of and for the account of a minor or a completely incapacitated person may be concluded only by their legal representatives, while partially incapacitated persons may conclude a contract only with the consent of their legal representatives. The terms of business of the mightylu.hr online store are drawn up in accordance with the Consumer Protection Act (Official Gazette 79/2007; 125/07; 79/09; 89/09), Chapter VII – Distance Contracts, and represent prior notice in the sense of Article 43 of the Consumer Protection Act. By ordering products, the customer confirms acceptance of the terms of business.

  1. Ordering

2.1. To place an order, you must be at least 18 years old and legally capable of entering into binding contracts.

2.2. All orders are subject to acceptance and availability. We reserve the right to refuse an order.

2.3. After placing an order, you will receive an email acknowledging receipt of your order. This email does not confirm acceptance of your order. The contract between us will be formed when we send you a confirmation email that the products have been dispatched.

  1. Pricing and Payment

3.1. Prices are listed in [euro] and include applicable VAT.

3.2. We reserve the right to change prices at any time. However, the price you pay will be the price displayed at the time you placed your order.

3.3. Prices do not include shipping costs. Shipping costs will be calculated and displayed during the checkout process.

3.4. Payment is done through the WooPayment. We accept major credit cards and other payment methods as indicated on our Webshop.

  1. Delivery

4.1. We deliver to following EU countries: Croatia, Slovenia, Austria, Germany, Italy,   France, Czech Republic, Hungary, Slovakia, Belgium, Denmark, Luxembourg, Netherlands, Poland, Portugal, Spain, Sweden, Switzerland and Norway.

Delivery costs and timescales will be specified during the checkout process.

4.2. Delivery times are estimates and we are not liable for any delays caused by customs or other factors beyond our control.

4.3. Risk of loss and title for products pass to you upon delivery.

  1. Returns and Refunds

5.1. You have the right to cancel your order within 14 days without giving any reason. The cancellation period will expire after 14 days from the day you receive the products.

5.2. To exercise the right to cancel, you must inform us of your decision by a clear statement at e-mail: info@mightylu.com

5.3. You must return the products to us in their original condition within 14 days of informing us of the cancellation. You will bear the cost of returning the products.

5.4. We will refund the price you paid for the products, including the cost of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type offered by us), within 14 days of receiving the returned products or proof of return.

  1. Liability

6.1. We are not liable for any indirect, special, incidental, or consequential damages arising out of or in connection with your use of our Webshop or purchase of products.

6.2. Our liability for any claim relating to the products will be limited to the amount you paid for the products.

7.1. We are committed to protecting your privacy and personal data. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

7.2. By using our Webshop, you consent to the processing of your personal data in accordance with our Privacy Policy.

  1. Governing Law and Jurisdiction

8.1. These Terms and Conditions are governed by the laws of Croatia.

8.2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Croatia.
